Governs use of mypariva.com and all associated services
1. Acceptance of Terms
By accessing or using MyPariva ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and MyPariva Technologies Pvt. Ltd. ("MyPariva", "we", "us").
2. Eligibility
To use MyPariva you must be:
- At least 18 years of age; OR
- At least 13 years of age with verifiable consent from a parent or legal guardian
By creating an account, you represent that you meet these eligibility requirements. MyPariva is intended for users in India but may be accessed globally subject to local laws. Users outside India are responsible for ensuring compliance with their local regulations.
3. Account Registration Responsibilities
- You must provide accurate, complete, and current information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately at support@mypariva.com if you suspect unauthorised access to your account
- You may not share your account with others or create accounts on behalf of third parties without their explicit consent
- You are responsible for all activities that occur under your account
4. Medical Disclaimer
MyPariva is not a medical device, diagnostic tool, or substitute for professional healthcare. Cycle predictions are estimates based on your logged data — not medical diagnoses. The fertile window predictions are not approved as a method of contraception. 5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of Indian law
- Use the care network feature to harass, stalk, or send unsolicited messages to third parties
- Scrape, crawl, or programmatically access the Service without our written permission
- Impersonate any person or entity, or misrepresent your affiliation
- Upload or transmit viruses, malware, or any code intended to damage or interfere with the Service
- Attempt to reverse-engineer, decompile, or circumvent any security feature of the Service
- Use the Service to collect personal data of others without their explicit consent
We reserve the right to suspend or terminate accounts that violate these rules without notice.
6. User Content
You own your personal health data. By using MyPariva, you grant us a limited, non-exclusive, royalty-free licence to process your data solely to provide and improve the Service, as described in our Privacy Policy. We do not claim ownership of your cycle logs, mood entries, or any other content you create.
We may use aggregated, anonymised data (which cannot identify you) for research, analytics, and service improvement without restriction.
7. Care Network Responsibilities
- You confirm that you have obtained explicit permission from each person before adding their contact details to your care network
- You understand that each supporter receives a WhatsApp consent request and that notifications are only sent after they agree
- Any supporter can revoke consent at any time by replying STOP to a WhatsApp notification, and you must honour such revocation immediately
- You must not add supporters' contact details without their knowledge or against their wishes
- MyPariva is not responsible for the content received by supporters being perceived negatively — you should discuss the app with supporters before adding them
8. WhatsApp & Email Communications
By adding a supporter to your care network, you authorise MyPariva to send WhatsApp and/or email messages to that person on your behalf. Message frequency depends on your cycle phase — typically 1–4 messages per month per supporter.
Supporters can opt out at any time. You can disable notifications for any supporter from your Care Network settings. We comply with WhatsApp Business API messaging policies and applicable Indian telecommunications regulations.
9. Intellectual Property
The MyPariva name, logo, and brand assets are trademarks of MyPariva Technologies Pvt. Ltd. All platform code, design, health article content, and notification templates are owned by us and protected under Indian copyright law.
You may not reproduce, distribute, or create derivative works from our content without our prior written consent.
10. Termination
By you: You may delete your account at any time from Profile settings. Termination is effective immediately upon deletion request.
By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any conduct that we determine, at our sole discretion, to be harmful to other users, third parties, or MyPariva. We will provide reasonable notice except where immediate action is necessary for safety or legal reasons.
Upon termination, your right to use the Service ceases immediately. Data deletion follows our retention policy as described in the Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by applicable Indian law, MyPariva's total liability to you for any claims arising from or related to the Service shall not exceed the total fees you have paid to MyPariva in the 12 months preceding the claim — which for free users is ₹0 (zero rupees).
MyPariva shall not be liable for: indirect, incidental, special, consequential, or punitive damages; loss of profits, data, or goodwill; or any harm arising from your reliance on cycle predictions, health content, or care network notifications.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CYCLE PREDICTIONS WILL BE ACCURATE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
13. Indemnification
You agree to indemnify, defend, and hold harmless MyPariva and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights, including supporters' privacy rights; or (d) any content you submit through the Service.
14. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause below, the courts of Bangalore, Karnataka, India shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Service.
15. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The place of arbitration shall be Bangalore, India. The arbitration shall be conducted in English by a sole arbitrator. The decision of the arbitrator shall be final and binding.
Nothing herein prevents either party from seeking emergency injunctive relief from a competent court pending resolution of a dispute.
16. Changes to These Terms
We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by email and in-app notification. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and delete your account before the effective date.
